 OFFICIAL RULES

1. NO PURCHASE NECESSARY.

2. You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.

3. Contest Dates: February 1, – February 14^th,  2010 

4. Winners: One, (1) grand prize winner

5. Prize Package: Two (2) Tickets to see TinTypes at the Maltz Jupiter Theatre. Performance date to be determined, tickets Will Not be for opening night.  Dinner for two at a restaurant to be determined, no cash value, Spa treatment for two at Lane Spa value $50.00.  The performance dates of the winning prize-tickets, and seat locations cannot be changed, exchanged or altered in any manner. 

6. Entry forms must be filled out completely and be received no later than midnight on Februart 14, 2010.

7. The winner of the essay contest is determined by CBS12 – WPEC staff.  All decisions are final. 

8. LIMITATIONS OF LIABILITY: By participating in the Contest, contestants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prize awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased, and any other damages, other than damages for actual out-of-pocket expenses.

9. CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision. In the event any such provision is determined to be invalid or unenforceable, the balance of these rules shall remain in full force and effect as if the invalid or unenforceable provision was not contained herein.

10. 16.GENERAL RELEASE: By participating in the Contest, contestants release WPEC/Freedom Broadcasting of Florida, Inc., and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

11. SPONSOR: By participating in this Contest, contestants agree to be bound by these Official Rules and by all decisions of the Sponsor, WPEC and The Maltz Jupiter Theatre. All decisions of WPEC relating to the administration of this CONTEST, including, without limitation, decisions relating to the eligibility of contestants, the award of the prizes, and the interpretation of these Official Rules, shall be final and binding in all respects. WPEC will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials. WPEC reserves the right in its sole discretion to suspend, modify or terminate this Contest if necessary to comply with any federal, state or local law, ordinance or regulation, or if WPEC determines in its sole discretion that the integrity of the Contest has been compromised by fraud, tampering, unauthorized human intervention or other causes beyond the reasonable control of WPEC which threaten to corrupt or impair the administration, security, fairness or proper operation of the Contest.

12. WPEC, SecondStreetMedia and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.

13. Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.

14. The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

15. CBS12 reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.

16. Employees of CBS12, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.

17. CBS12/WPEC shall not be liable for lost or stolen entries, personal or property injury, losses or failure of providers in connection with awarding of this prize.

20. No substitution or transfer of prizes permitted.

21. Limited to one prize per office, household or family.

22. Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.

23. Entrants further grant to CBS12 and the Maltz Jupiter Theatre has the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.

24. CBS12 and the The Maltz Jupiter Theatre reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.

25. The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or CBS12. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

26. Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.

27. UPICKEM and CBS12 are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.

28. All results posted are unofficial until winners respond to e-mail notification.

29. Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.

30. This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.

31. CBS12 reserves the right to change the rules at any time.
